Why in News?
Recently, the issue of a floor test gained attention after the Governor of Tamil Nadu reportedly asked TVK president C. Joseph Vijay to prove majority support in the Legislative Assembly.
What is a Floor Test?
A Floor Test is a constitutional mechanism used to verify if the Chief Minister (Executive) still has the support of the Legislative Assembly (Legislature).
- Purpose: To ensure the government enjoys the “confidence” of the house.
- Presiding Officer: Presided over by the Speaker.
Important Constitutional Articles
- Article 174: Gives the Governor power to summon, dissolve, and prorogue the Assembly.
- Article 175(2): Empowers the Governor to call for a floor test to prove the government’s numbers.
- Article 163: Generally, the Governor acts on the “aid and advice” of the Council of Ministers. However, the Governor can use discretionary powers if the Chief Minister’s majority is in doubt.
Who Calls the Test?
- When in Session: The Speaker holds the authority to call for a test.
- When Not in Session: The Governor can use residuary powers under Article 163 to summon the house for a test.
The Process & Outcome
- Voting Rule: The majority is calculated based on members “present and voting.” Those who are absent or abstain are excluded from the count.
- The Result: If the Chief Minister fails to prove a majority, they must resign. This results in the dissolution of the entire Council of Ministers.
Supreme Court Judgments on Floor Test
- In S.R. Bommai Case(1994), the Supreme Court held that majority should be tested on the floor of the House, not decided by the Governor subjectively.
- In the Nabam Rebia and Bamang Felix vs Deputy Speaker case, the Supreme Court held that the Governor cannot summon the Assembly at his own discretion and must normally act on the aid and advice of the Council of Ministers.
- In Shivraj Singh Chouhan vs Speaker, Madhya Pradesh Legislative Assembly, the Court upheld that a floor test can be ordered when there is credible material indicating that the government may have lost majority support.
- The Supreme Court (2023) ruled that a floor test cannot be used by the Governor to settle internal or intra-party disputes.
